The rules that govern your use of Swerve and related services

These Terms of Service ("Terms") govern your access to and use of Swerve, including AI character chat, roleplay conversations, character creation, subscriptions, credits, and support services (together, the "Service").
By creating an account, buying a plan, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 13 years old, or the minimum age required in your country, to use the Service. If you are under the age of majority where you live, you may use the Service only with consent from a parent or legal guardian.
Swerve is not designed for young children. We may restrict features, remove content, or terminate accounts where age, safety, or legal requirements make that necessary.
You are responsible for keeping your login credentials secure, providing accurate account information, and all activity that happens through your account unless caused by our own fault.
Swerve lets users chat with AI characters, create or customize personas, explore fictional scenarios, and save conversation-related content. AI characters are fictional. They are not real people, professionals, emergency services, therapists, doctors, lawyers, or financial advisors.
Features, limits, memory behavior, model quality, availability, and pricing may vary by plan, region, product surface, or promotional offer. We may change, improve, or retire features over time.

You keep ownership of content you submit to the Service, such as prompts, character descriptions, profile details, feedback, uploaded images where supported, and chat messages ("Inputs"). You give us a worldwide, non-exclusive, royalty-free license to host, reproduce, process, modify, and transmit those Inputs only as needed to operate, secure, improve, and support the Service.
AI responses, character replies, and other generated content may be similar or overlapping across users. We do not guarantee that AI outputs are unique, accurate, appropriate, legally safe, or suitable for your intended use.
If you publish, share, or make content visible through the Service, you give us a non-exclusive license to host, display, distribute, promote, and feature that content within the Service and related marketing channels unless you later remove it where that option exists.
You may not use the Service to:
We may investigate misuse and may remove content, restrict features, cancel orders, suspend accounts, or terminate access that violates these Terms.
Swerve is not emergency support. If you or someone else may be in immediate danger, contact local emergency services or a crisis hotline.

Parts of the Service rely on third-party providers such as authentication, payments, analytics, hosting, storage, email, and AI model providers. Those providers may have their own terms and privacy policies, and we are not responsible for products or services they provide directly to you.
The Service itself, including our software, brand, design, documentation, and site content, is owned by Swerve or our licensors and is protected by applicable intellectual-property laws. These Terms do not give you ownership in our Service, trademarks, or brand assets except for the limited right to use the Service as allowed here.
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or applicable law, create security or abuse risk, fail payment checks, or if we stop offering the Service.
Termination does not cancel obligations that already arose, including payment obligations, license grants needed to run the Service, dispute provisions, and limits on liability.
The Service is provided on an "as is" and "as available" basis. To the maximum extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
We do not promise that the Service will always be available, that AI characters will always respond as expected, or that any AI output will be accurate, safe, unique, or suitable for your intended use.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, or business opportunities. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the specific Service giving rise to the claim in the 12 months before the claim arose.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
You agree to defend, indemnify, and hold us harmless from claims, losses, liabilities, damages, and expenses arising out of your Inputs, AI outputs you use or share, your use of the Service, your breach of these Terms, or your violation of law or third-party rights.
We may update these Terms from time to time. If we make a material change, we will post the updated Terms and may provide additional notice. By continuing to use the Service after the updated Terms take effect, you agree to the revised Terms.
Unless mandatory consumer law says otherwise, these Terms are governed by the laws of the jurisdiction where the operator of Swerve is established, without regard to conflict-of-law rules.
